Terms of Service

These Legal Terms constitute a binding agreement between you and Plowdesk, LLC concerning your access to and use of the Plowdesk website, mobile application, and related products and services.

1. Our Services

The Services are not intended for distribution where doing so would violate law or create a registration requirement. Users accessing the Services from other locations are responsible for compliance with applicable law.

2. Intellectual Property Rights

Plowdesk owns or licenses the source code, databases, functionality, software, designs, text, photographs, graphics, trademarks, and other content associated with the Services. You receive a limited license to access the Services for internal business purposes.

3. User Representations

You agree to provide accurate information, maintain its accuracy, protect your password, use the Services only for lawful purposes, and comply with these Terms.

4. Purchases, Subscriptions, and Renewal

Charges are shown in US dollars. Subscriptions renew at the end of each term unless canceled. We will provide notice of material pricing changes. Free trials may convert to paid subscriptions as disclosed during signup. Purchases are non-refundable except where required by law.

5. User Contributions

You are responsible for content you submit and must have the rights needed to share it. Contributions must not be unlawful, misleading, offensive, or infringing.

6. Mobile Application License

We grant a limited, non-transferable license to use the Application. You may not reverse engineer, reproduce, or redistribute it except as permitted by law.

7. Third-Party Websites

The Services may link to third-party sites. Plowdesk does not control or endorse third-party content and is not responsible for losses arising from your use of those sites.

8. Service Management and Termination

We may monitor the Services, remove content, limit access, or terminate accounts where necessary to protect the Services, enforce these Terms, or comply with law.

9. Governing Law and Disputes

These Terms are governed by New Hampshire law. Disputes will be resolved through binding arbitration in Rockingham County, New Hampshire, except where the law permits another remedy.

10. Liability and Indemnification

To the extent permitted by law, liability is limited to amounts paid during the preceding twelve months, and indirect or consequential damages are excluded. You agree to indemnify Plowdesk for claims arising from misuse of the Services or breach of these Terms.

11. Communications and SMS

You consent to electronic communications and signatures. Where you opt in to SMS messaging, standard rates may apply; reply STOP to opt out.
